2009 Southwest Airlines “Ultimate Gamer” Online Sweepstakes - Official Rules
- Eligibility: NO PURCHASE NECESSARY. PURCHASE WILL NOT ENHANCE YOUR CHANCES OF WINNING. Open to legal U.S. resident in the 48 contiguous states, 18 years of age or older as of July 8, 2009. Employees and directors of Major Gaming Championships (“MGC”) and Southwest Airlines (“SWA” or “Sponsor”) and their respective parent entities, subsidiaries and affiliated companies and advertising, promotion, production agencies, service providers, web masters and web suppliers (collectively, “Promotional Participants”) and their respective employees, directors, representatives, agents, dependents, immediate family members and individuals residing in their same household, are not eligible to participate in the 2009 Southwest Airlines Ultimate Gamer Online Sweepstakes (the “Sweepstakes”). Void where prohibited. By participating, entrants agree to these Official Rules (the “Official Rules”).
- Sweepstakes Dates: The Sweepstakes will take place between 12:01 a.m. CT, on July 17, 2009 and midnight (11:59 p.m. CT) on October 17, 2009. The Sweepstakes will be open to qualified entrants who go to www.midnightgamingchampionship.com or www.southwest.com/mgc and complete the official entry form.
- To Enter: You may enter online at “www.midnightgamingchampionship.com” by clicking on the indicated sweepstakes icon, banner or text link which will redirect you to www.southwest.com/mgc. Follow the online registration instructions and complete the official online registration entry form by providing your full name, e-mail address, city, state and zip code where you reside and following the instructions for submitting the entry. The odds of winning depend on the number of entries received. All entries become the property of Sponsor. A person may enter only one (1) time.
- Prizes: On October 18, 2009, at
Southwest Airlines Headquarters, two (2) official entrants will be randomly
drawn by
computer program and each will
receive two (2) event tickets to the Video Gamer Awards in Las Vegas, NV
(suggested retail value of $400), two (2) free roundtrip airline tickets
on Southwest
Airlines to Las Vegas, NV (Southwest Airlines roundtrip tickets will be from
the closest major airport to winner’s residence that is served by Southwest
Airlines with valid, scheduled service to Las Vegas) (suggested retail value
of $800), hotel accommodations and ground transportation for two (2) persons
(suggested retail value of $500), along with one (1) Xbox360 (suggested retail
value of $350), one (1) PlayStation3 (suggested retail value of $400), and
one (1) Nintendo Wii (suggested retail value of $250).
The winners may not substitute, assign or transfer prizes, and MGC reserves the right, in its sole discretion, to substitute a prize with another prize of equal or greater value should the advertised prize become unavailable for any reason. Gift cards are NOT redeemable or exchangeable for cash. The official winners will be required to show a photo ID that must correspond to the name that appears on that participant’s official registration entry form.
EACH WINNER WILL BE REQUIRED TO COMPLETE AND SIGN AN AFFIDAVIT OF ELIGIBILITY AND LIABILITY RELEASE AND, WHERE LEGAL, PUBLICITY RELEASE, AND RETURN THE RELEASES TO SPONSOR WITHIN SEVEN (7) DAYS AFTER PRIZE NOTIFICATION OR THE PRIZE WILL BE FORFEITED AND AWARDED TO AN ALTERNATE WINNER. - Conditions of Participation: Participants agree (a) that MGC, Promotional Participants, Sponsor and their respective parent entities, subsidiaries and affiliated companies, advertising and promotion agencies, and their respective officers, directors, employees, representatives and agents will have no liability whatsoever for, and shall be held harmless against any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, failure to accept possession, failure to use, misuse or use of any prize or participation in this Sweepstakes or any Sweepstakes-related activity, or for any typographical or other error in the printing, offering or announcement of any prize; and (b) except where legally prohibited, winners grant (and agree to confirm that grant in writing) permission for MGC and those acting under its authority to use a winner’s name, photograph, voice and/or likeness, for advertising, trade and/or publicity purposes without additional compensation in all media now known or hereafter discovered, worldwide and on the World Wide Web, without notice, review or approval. If documents are not returned on a timely basis (at the sole determination of MGC), or if any prize notification or prize is returned as non-deliverable, or if the winner is found to be ineligible or not in compliance with these Official Rules, such prize will be forfeited and an alternate winner selected. Any taxes on prizes are solely the participant’s responsibility. By participating in this Sweepstakes, you acknowledge and agree that MGC may collect the personal information submitted by you, and use the information pursuant to MGC’s privacy policy available online at the MGC Website and www.southwest.com/mgc.
- Limitations of Liability: Neither
MGC or SWA, nor their Promotional Participants are responsible for lost,
late, misdirected, incomplete, non-delivered or
unintelligible online entries; or for interrupted or unavailable satellite,
network, server,
Internet service provider (ISP), web site, telephone or other connections,
availability or accessibility, or miscommunications, or failed computer,
satellite or cable transmissions, or lines, or technical failure or jumbled,
scrambled,
delayed, or misdirected transmissions, or computer hardware or software malfunctions,
failures or difficulties, or other errors of any kind whether human, mechanical,
electronic or network or the incorrect or inaccurate capture of entry or
other information or the failure to capture any such information. Participants
who
tamper with or abuse any aspect of this Sweepstakes, as solely determined
by the MGC, will be disqualified. Entries generated by a robotic, programmed,
script, macro or other automated means will be disqualified. Neither MGC
or
SWA, or their Promotional Participants are responsible for injury or damage
to a participant’s or any other person's computer related to or resulting
from participating in this Sweepstakes or downloading materials from or use
of the MGC or SWA web site. Should any portion of this Sweepstakes be, in
MGC’s
sole opinion, compromised by virus, worms, bugs, non-authorized human intervention
or other causes which, in the sole opinion of the MGC, corrupt or impair
the administration, security, fairness or proper play, or submission of entries,
MGC reserves the right, in its sole discretion, to suspend, modify, or terminate
the Sweepstakes, and select winners from entries received prior to action
taken
or as otherwise deemed fair and appropriate by MGC. Neither MGC or SWA, or
their Promotional Participants are responsible for any incorrect or inaccurate
information, whether caused by web site users, tampering, hacking, or by
any equipment or programming associated with or utilized in the Sweepstakes,
and
assume no responsibility for any error, interruption, deletion, defect, delay
in operation, or transmission, communications line failure, theft or destruction,
or unauthorized use to MGC or SWA web site. In the event of a dispute regarding
entries received from multiple users having the same e-mail account, the
authorized subscriber of the e-mail account at the time of entry used to
enter will be
deemed to be the entrant and must comply with these Official Rules. Authorized
account subscriber is the natural person who is assigned the e-mail address
by the Internet Service Provider (ISP), on-line service provider, or other
organization responsible for assigning e-mail addresses.
