SWABIZ Terms of Service

1. General

By logging onto SWABIZ, you agree to comply with all terms and conditions herein and the terms and conditions contained in Southwest's Terms & Conditions and Contract of Carriage (hereinafter collectively referred to as "Terms"). Furthermore, you agree to receive commercial e-mail from Southwest Airlines Co. (“Southwest”) that may assist in planning travel including, but not limited to fare information, new service, etc. If you want to opt-out of receiving SWABIZ commercial e-mail from Southwest then contact SWABIZ help desk at 888-479-2249. If you opt out of receiving SWABIZ commercial emails, Southwest may continue to send you non-commercial SWABIZ e-mails and other types of communications, as permitted by law, such as those about our ongoing business relations. For example, Southwest may send e-mails that contain service-related announcements that affect your account, confirmations and updates regarding flight reservations you have made, requests for feedback on our services and/or your specific travel experiences, or responses to your comments and feedback submitted to Southwest. Fares available on SWABIZ are the only fares available for travel and tracking purposes. If you do not agree to these Terms, please do not use this site. Please check the Terms periodically for changes. Your continued use of this site following the posting of any changes to the Terms constitutes your acceptance thereof.

SWABIZ is for business travel only. If you are traveling for vacation or leisure, please plan and purchase your travel at southwest.com.

A valid credit card acceptable to Southwest (see Contract of Carriage), flight credits, southwest gift cards, and Southwest LUV Vouchers are the only acceptable means of purchasing air travel on Southwest Airlines on SWABIZ.

Southwest shall provide Company with a Company ID (hereinafter "CID"), which Company employees must use to book each reservation made with Southwest on SWABIZ. To make changes to reservations booked on SWABIZ, Company Travel Managers or authorized business travelers of Company may use the change feature on SWABIZ. If you are an authorized business traveler of Company, please obtain your CID from your Company Travel Manager. This CID should not be given to any unauthorized persons.

This agreement is entered into between Southwest and the enrolled SWABIZ Company. Southwest shall provide Company Travel Manager with detailed information concerning and relating to air, car, hotel, and other travel booked, reserved, or purchased by business travelers using the CID. These reports should not be shared with persons not affiliated with Company and should be maintained in the strictest confidence. If the enrolled SWABIZ Company share their CID and/or reports with any 3rd party group, Southwest will not be held responsible for any damages or costs related to loss or unauthorized use or abuse of data.

Company shall not be entitled to any compensation, including commissions, rebates or travel discounts, for use of SWABIZ by authorized business travelers of Company.

A flight credit can either be used by the Passenger on Southwest or, as agreed to by Southwest, if evidence satisfactory to Southwest, in its sole discretion, is submitted to Southwest that a company purchased the Ticket on behalf of its employee or the travel agent has made a refund to its client, then the flight credit may be held for use by the company or travel agent, as applicable.

2. Representations and Warranties

The Company Travel Manager, Company, and Company’s other representatives with access to Company’s SWABIZ account represent and warrant that: (i) each is legally authorized to process any information that it processes in relation to travelers associated with Company’s SWABIZ account, and that any such processing will not violate any applicable laws, rules, regulations, directives, or orders in any jurisdiction where SWABIZ is used; (ii) each has all rights and authority to act on behalf of and provide consent on behalf of account users associated with Company’s account; (iii) each will comply with all applicable laws, rules, regulations, directives, and orders in any jurisdiction where SWABIZ is used, as well as the Southwest.com Terms & Conditions and Privacy Policy; and (iv) each will not use any individual’s or third party traveler’s information, including payment card information or account details, for any purposes not expressly authorized by such individual or third party, or as otherwise permitted by law.

3. Indemnification

By logging onto SWABIZ, creating an account, or accessing or using this website, you agree to defend, indemnify, and hold harmless Southwest and its affiliates and related companies, and each of their respective employees, contractors, officers, agents and directors from all liabilities, claims, damages, judgments, penalties, taxes, fines, costs, and expenses (including attorneys' fees), that arise from or relate to: (i) the use or misuse of SWABIZ by Company, a Company Travel Manager, any of Company’s account users or managers, or travelers of Company; (ii) the breach by any of the foregoing of any representations or warranties made herein, or the violation of these Terms of Service or any other agreement you have with Southwest; (iii) any actual or alleged violations of applicable laws, rules, regulations, decrees, or orders in any applicable jurisdiction; or (iv) any information, including personal information, you supply to us either on your behalf or on behalf of a third party.
